Vincent Olatunji, national commissioner and chief executive officer (CEO) of the Nigeria Data Protection Commission (NDPC), has ordered an immediate investigation into the data processing activities of Temu.
In a statement on Monday, Babatunde Bamigboye, head of legal, enforcement and regulations at NDPC, said the platform’s activities “may be in violation” of the Nigeria Data Protection Act (NDP Act), 2023.
Bamigboye said the probe was triggered by concerns relating to online surveillance through personal data processing, accountability, data minimisation requirements, transparency, duty of care and cross-border data transfers.
“Preliminary investigations indicate that Temu is an e-commerce platform which processes personal information of approximately 12.7 million data subjects in Nigeria with 70 million daily active users globally,” the statement reads.
According to the statement, the national commissioner warned that data processors who carry out processing activities on behalf of data controllers without verifying their compliance with the NDP Act may be held liable under the law.
On February 5, the Nigerian Communications Commission (NCC) and the NDPC signed a memorandum of understanding (MoU) to strengthen collaboration on data privacy and protection in the country.
NDPC said the partnership was necessary to combine the expertise and capacities of both agencies to effectively protect Nigerians’ data.
